William Waweru Maina and another individual are scheduled for hearings on Monday and Tuesday, September 7 and 8, regarding the alleged procurement of No. 1 uniform materials worth Sh11.5 million. The two are charged with wilful failure to comply with applicable law relating to the procurement of services.
Embezzlement Charges Involving National Treasury and County Programs
Financial misconduct cases on this week’s docket feature substantial sums linked to rural innovation and educational projects. John Ngure Kabutha and 31 others face charges including abuse of office, unlawful acquisition of public property, uttering a false document, financial misconduct, acquisition of proceeds of crime and three counts of money laundering.
The Milimani Anti-Corruption Court will also hold a mention on Tuesday, September 8, in the case involving John Ngure Kabutha and 31 others. The allegations relate to the alleged embezzlement of Sh1.6 billion by officers of the National Treasury coordinating the Programme for Rural Outreach of Financial Innovation and Technologies through unlawful payments to business entities. Meanwhile, a separate mention involving Samburu East District Education Officer Joel Kaunda Ontoya and three others is scheduled for Monday, September 7, at the Anti-Corruption Court in Isiolo. The four are charged with abuse of office over the alleged embezzlement of Sh999,998 by the DEO during the 2015/2016 and 2016/2017 financial years.
Bribe Allegations and Trans Nzoia Employment Fraud Mentions

In Nyeri, the Anti-Corruption Court will on Monday hold a mention in the case involving Kangema principal probation officer Julius Irungu Njogu. Njogu is charged with receiving a bribe. He is alleged to have requested Sh170,000 from a defendant on behalf of a chief magistrate at Kangema Law Courts.
On Wednesday, September 9, the Anti-Corruption Court in Kitale will hold a mention in the case involving Peggy Makungu Malova and Cleophas M. Maende. The two are charged with deceiving a principal after allegedly presenting fake certificates to secure employment and promotion at the Trans Nzoia county government.
Legal Thresholds and Discharge Applications in South African Proceedings
Last week, the former defence minister argued that the State has failed to prove its case against her. Mapisa-Nqakula is facing 12 counts of corruption and one of money laundering for allegedly soliciting corrupt payments from a contractor between 2016 and 2019 when she was the Defence Minister. If the court rules in Nosiviwe Mapisa-Nqakula’s favour in her discharge application, then she will be acquitted of the charges against her without having to call a witness to the stand.
Last week, her lawyers argued that the State failed to prove any actions by the former defence minister that point to any intention to commit the crime. They also argued that the evidence of the State’s star witness, Nombasa Ntsondwa-Ndhlovu, who claims to have paid Mapisa-Nqakula, lacks a material element, which is why she was giving money to the former minister. However, prosecutors say the State led evidence to show that there was no legitimate reason for Mapisa-Nqakula to demand or receive any payment from Ntsondwa-Ndhlovu, saying that the evidence stands undisputed.
