Crocs Sues Five Below Over $7 Clog Design

Crocs and its subsidiary Jibbitz filed a federal lawsuit in Colorado on September 18, 2026, accusing discount retailer Five Below of trademark and patent infringement over a $7 pair of clogs and accompanying decorative charms that allegedly copy the footwear design.

Crocs is taking legal action against Philadelphia-based discount retailer Five Below, alleging that the company knowingly sold knockoff versions of its famous foam footwear. The footwear giant and its Jibbitz subsidiary filed the complaint in U.S. District Court in Colorado, where Crocs is based.

At the center of the dispute is Five Below’s Juniors Charm Clog, which was listed online for $7 before appearing as sold out. According to court documents, the discount shoe mimics distinct protected attributes of the Classic Clog, including the specific arrangement of ventilation holes, trapezoid-shaped openings, and a textured heel strap. Legal filings state that these design overlaps could lead consumers to believe the Five Below shoes are affiliated with Crocs.

Disputed Charms, Patents, and Unheeded Warning Letters

The litigation extends beyond the foam shoes themselves. Jibbitz asserts that decorative charms sold alongside the discount footwear infringe upon three patents governing the attachment systems used to personalize footwear. Furthermore, Crocs claims that a Five Below Novelty Shoe Purse also copies elements of both the classic footwear silhouette and an official bag charm.

Before escalating the dispute to federal court, Crocs attempted an out-of-court resolution. Attorneys sent a formal demand letter on March 4 detailing the intellectual property concerns. While Five Below acknowledged receipt of the correspondence, the discount chain continued selling the disputed products.

Contrasting Retail Models and Prior Dupe-Driven Strategy Lawsuits

The financial scale of the two companies highlights a stark contrast in the retail marketplace. Crocs reports selling roughly 150 million pairs of shoes annually with revenues exceeding $4 billion. Adult classic clogs generally retail between $50 and $65, while kids’ versions sell for about $40. In contrast, Five Below operates more than 2,000 stores across 46 states and has posted strong financial growth under CEO Winnie Park, who assumed leadership in December 2024 to reaffirm the company’s positioning as an extreme-value retailer.

Legal analysts note that fashion design patent litigation presents significant hurdles in court, requiring plaintiffs to establish deliberate imitation. Five Below has faced similar intellectual property challenges over budget-friendly alternatives in recent years, including lawsuits regarding Stanley drinkware and Supergoop sunscreen.

In the current action, Crocs and Jibbitz are requesting a jury trial, an award for unspecified damages including lost profits, attorney fees, a permanent injunction against further sales, and the destruction of infringing inventory.
