The latest travel restriction unfolds just days after a federal judge intervened to temporarily halt a White House ban targeting CNN alongside MS NOW and Politico. U.S. District Judge Timothy Kelly issued an overnight ruling striking down the initial grounds for keeping the news outlets off White House grounds, though questions immediately surfaced regarding how the reprieve applied to travel pools and presidential aircraft assignments.
Air Force One Assignment Shifted to Real America’s Voice
For Saturday’s journey to Knoxville, Tennessee, where President Trump is scheduled to attend a college football game between the University of Tennessee and the University of Texas, the White House assigned Real America’s Voice to the spot normally held by CNN. The seat on the presidential plane is part of a U.S. network video pool, a five-member rotation of major broadcast organizations that document and share footage of the executive branch. Real America’s Voice is not a part of that pool.
The reassignment follows a week of shifting access. Earlier in the week, journalists representing CNN, MS NOW, and Politico returned to the executive complex with TV cameras following Judge Kelly’s temporary restraining order. Video feeds briefly resumed, showing Trump touring the National Archives alongside Chinese President Xi Jinping. Yet that return to routine pool reporting proved short-lived as the administration moved forward with travel restrictions.
Legal Battles Over Due Process and White House Grounds Access
During Wednesday’s court hearing in Washington, Judge Kelly expressed skepticism toward the administration’s actions, noting that the affected newsrooms received no meaningful opportunity to defend themselves before losing their credentials. Drawing on established D.C. Circuit precedents including Sherrill v. Knight from 1977 and Karem v. Trump from 2022, the judge emphasized that Fifth Amendment due process protections apply when officials revoke a journalist’s White House access.
Justice Department attorneys defended the administration’s stance by submitting letters delivered to the outlets shortly before the hearing. The government argued that the organizations had violated standards of professionalism, accusing them of publishing classified details and circulating inaccurate claims. Government counsel Michael Velchik argued that entering the executive complex remains a privilege, maintaining that the president must retain authority to protect sensitive state operations swiftly.
Broadcast Pools Solidarity and First Amendment Objections
Representing the news outlets, attorney Theodore Boutrous Jr. pushed back against the government’s justification, telling the court that arguments about national security were introduced after the lawsuit was filed. Boutrous argued that the disciplinary letters established retroactive rules punishing organizations for past coverage rather than setting clear expectations beforehand.
The restrictions also triggered coordinated pushback within the press corps. When CNN was initially barred from traveling to New York for the United Nations General Assembly, four other television networks suspended the shared pool altogether in an unprecedented display of solidarity. While Judge Kelly’s initial injunction restored physical grounds passes for reporters, questions regarding airplane seats and cooperative video coverage remain unsettled as the legal dispute continues.
