A federal American judge has ordered the American administration in a decision published during the night of Wednesday 23 to Thursday 24 September to immediately restore
access to the White House for CNN, MS NOW and Politico. The three American media outlets had been banned from entering the White House with immediate effect by the American administration, accused by Donald Trump of spreading false information.
Federal Court Orders Immediate Restoration of White House Press Access
The legal dispute centers on a sudden ban enacted by Donald Trump, who blocked the three media outlets from entering the White House with immediate effect. the access to the White House for CNN channels and MS NOW and the online media Politico. The three media outlets responded on Monday by taking legal action against a direct violation of the First Amendment
of the US Constitution, guaranteeing press freedom, and a blatant violation of our most fundamental constitutional principles.
U.S. District Judge Timothy Kelly issued an injunction requiring the executive branch to reestablish and return accreditation badges to the affected correspondents. He consequently ruled that the American executive must immediately restore and return the accreditation badges of their correspondents until further notice or the expiration of this order, which is currently in effect for two weeks.
Federal Judge Timothy Kelly noted that as a general rule individuals must be given prior notice and an opportunity to be heard before the government deprives them of a constitutionally protected interest.
Constitutional Due Process and the Legal Arguments in Court
During court proceedings, Judge Kelly emphasized that established case law demands specific procedural safeguards before revoking a journalist’s White House access. Or the concerned journalists were only informed of a possibility of appeal on Wednesday, several days after the confiscation of their badges. According to CNN, the judge considered that the withdrawal of the journalists’ accreditations had been decided without following a procedure sufficiently compliant with constitutional guarantees.
Government attorneys attempted to defend the exclusion by invoking national security grounds. Before the court, the Justice Department also invoked national security reasons to justify the exclusion. The media attorneys countered that this argument only emerged after the announcement of the ban and the filing of their complaint.
This is not the first time Judge Kelly has addressed White House press credentials. Timothy Kelly had previously ruled on a similar dispute in 2018, when the White House revoked the accreditation of CNN journalist Jim Acosta. He then ordered its restoration, already in the name of respecting the procedure.
Solidarity Among Media Outlets and Press Pool Disruptions
The exclusion of CNN, MS NOW, and Politico quickly disrupted daily reporting operations at the presidential estate. The Trump administration’s decision also triggered a solidarity movement among their colleagues, who then refused to broadcast statements by the Republican president or block the publication of press photos of Donald Trump for a time.
The boycott left standard press briefings temporarily devoid of regular technical equipment and microphones. The exclusion of CNN, MS NOW and Politico also disrupted the functioning of the White House press pool. Several major networks had suspended their participation in solidarity with the targeted media, depriving certain presidential events of the usual technical means of coverage. On Monday, no microphone was present to record Trump’s statements.
