Hanoi Court Retries Đinh Tiến Hùng in Illegal Mining and Explosives Case

The trial opened at the People’s Court of Hanoi, bringing back into the courtroom a tangled criminal case that originally began in January 2021 under the security investigation agency of the former Yên Bái police department. At the center of the proceedings is Đinh Tiến Hùng, the 42-year-old former deputy secretary of the Yên Bái Provincial Youth Union. He stands alongside nine other defendants facing charges for transporting and using explosive materials without authorization, alongside violations of resource extraction regulations.

The legal trajectory shifted dramatically after a November 2023 ruling by the People’s Court of Yên Bái Province, which declared Đinh Tiến Hùng not guilty. The provincial prosecutor’s office immediately lodged an appeal. By late 2024, the High People’s Court in Hanoi annulled the initial verdict entirely and ordered a fresh investigation. The case was subsequently transferred to the Ministry of Public Security’s security investigation division before reaching the Supreme People’s Procuracy for indictments.

Ore Extraction at Núi Ngàng and the Financial Stakes

According to the indictment filed by the Supreme People’s Procuracy, the criminal enterprise took shape between July and December 2020. The primary motive centered on recovering an initial 10 tỷ đồng contribution that various figures had pooled together. To recoup their money, Đinh Tiến Hùng joined forces with Nguyễn Văn Hậu, director of Tuyên Huy Co. Ltd., alongside company vice directors Nguyễn Trọng Tuấn and Bùi Mạnh Hùng, as well as independent operator Nguyễn Mạnh Hùng.

Investigators determined that the group agreed to split profits unevenly, with the former youth union leader slated to receive one-third of the proceeds while the remaining two-thirds went to Tuyên Huy and associated participants. The operational plan delegated specific illegal tasks across the roster. Independent operator Nguyễn Mạnh Hùng was tasked with finding and hiring blasters to harvest ore-bearing rock at the Núi Ngàng mine, while Lăng Đức Hân, director of Ngọc Tâm Trading Co. Ltd., handled administrative cover.

Hân secured approval from local authorities in Yên Bình District to repair and upgrade an access road leading to the mine. Investigators established that the road repair project served as a pretext to obtain official permits for transporting explosives, which were then diverted to blast and extract lead-zinc ore illegally. Ngọc Tâm company was authorized to transport roughly 868 kilograms of industrial explosives and 863 detonators, but Hân directed warehouse keeper Trần Đắc Việt to issue quantities far exceeding those limits.

Explosive Volumes and Confirmed Material Seizures

The scale of the unauthorized extraction operations involved thousands of kilograms of restricted materials distributed across a structured logistics chain.

Scrutiny Over the Initial Acquittal and Judicial Conduct

Beyond the core mining charges, the new indictment details extensive administrative fallout and points toward potential misconduct within the local judiciary and government offices. Prosecutors explicitly cited the original trial bench at the People’s Court of Yên Bái Province as the primary source of the erroneous 2023 acquittal, prompting formal recommendations for the Supreme People’s Court to inspect and handle leadership accountability.

The re-investigation also uncovered financial allegations tied to the first trial. Defendant Nguyễn Mạnh Hùng claimed he handed 500 triệu đồng to court secretary Nguyễn Thu Trà during the preliminary proceedings to secure a suspended sentence. While the staff member denied receiving any money, investigators found no documentary proof of bribery. Because the claims touch upon judicial integrity, the Ministry of Public Security transferred those records to the investigation body of the Supreme People’s Procuracy.

Separate inquiries evaluated former provincial leadership. Investigators noted that former Yên Bái Party Secretary Đỗ Đức Duy discussed case details with Đinh Tiến Hùng while the matter was pending. However, authorities concluded that the former leader did not engage in corruption or negativity and that the shared information was already known to the suspect through official questioning, rendering further administrative penalties redundant given earlier internal party discipline.

Local Official Approvals and Detention Violations

Investigators similarly reviewed the conduct of municipal administrators who approved the road repair project without proper procedural steps. Former Yên Bình District Chairman Nguyễn Xuân Trường—now serving as deputy head of the organization committee for the Lào Cai Provincial Party Committee—along with retired economic official Hoàng Thị Duyên and staff member Lương Năng Hưng, faced review for fast-tracking the infrastructure upgrade.

While state investigations found no evidence of corrupt motives or financial kickbacks among these officials, prosecutors concluded they failed to recognize that the road project would be weaponized to conceal illegal mining. The agency recommended that provincial authorities in Lào Cai apply strict party and administrative discipline against the individuals involved.

Additional procedural breaches surfaced regarding the management of detainees. Investigators established that specific police officers and security staff at the Yên Bái detention facility permitted family visits and arranged unauthorized meetings between key defendants—including Nguyễn Văn Hậu, Nguyễn Trọng Tuấn, and Bùi Mạnh Hùng—to resolve civil matters. Although state bodies determined the officers acted without corrupt intent and caused no lasting damage, the security agency flagged the actions as violations of the Law on Temporary Custody and Detention, forwarding the findings to regional police oversight.
