Following more than 17 hours of deliberations across four days in Plymouth Superior Court, jurors in the Lindsay Clancy murder trial told Judge William Sullivan on Tuesday that they were unable to reach a unanimous verdict regarding the 2023 deaths of her three young children.
The nine women and three men weighing the high-profile Massachusetts case submitted a note to the court on Tuesday morning around 10 a.m., stating simply that they could not come to a unanimous agreement after many hours of deliberations. The development marks the first significant impasse in a trial that stretched across five weeks of emotional testimony and detailed evidence review in Plymouth, Massachusetts.
Judge Sullivan Directs Jury to Resume Deliberations
Rather than declaring a mistrial or releasing the panel, Judge William Sullivan called the prosecution and defense attorneys to a sidebar before bringing the jurors back into the courtroom. Acknowledging the enormous scope of the proceedings—which included testimony from more than 80 witnesses and the review of over 300 exhibits—Sullivan directed the panel to continue working toward a decision.
As deliberations stretch into their fourth day, Sullivan’s directive stopped short of issuing Massachusetts’ formal “Tuey-Rodriguez” charge, commonly known as the state’s dynamite charge for deadlocked juries. Legal analysts note that if the panel reports a definitive impasse again, a formal instruction could follow, which would restrict the judge from sending the jurors back out if they remain deadlocked.
Core Defense Centers on Postpartum Psychosis
The 36-year-old defendant, a former labor and delivery nurse, has acknowledged killing her children—5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan—on January 24, 2023, inside the family’s Duxbury home. However, Clancy has pleaded not guilty by reason of lack of criminal responsibility.
Her defense team argues that she was suffering from severe postpartum psychosis and a profound break from reality at the time of the strangulations, which were executed using exercise bands before Clancy slashed herself and jumped from a second-story window, leaving her paralyzed. Defense attorney Kevin Reddington expressed confidence in the jury despite the emotional strain of the lengthy proceedings, stating he would continue representing Clancy if the case results in a mistrial and requires a retrial.
In contrast, prosecutors maintain that Clancy was capable of distinguishing right from wrong and deliberately planned the killings, pointing to actions such as arranging for her husband to leave the house prior to the incident.
Weighing Charges and Verdict Options
The jury faces a complex set of outcomes across multiple charges, ranging from first-degree murder convictions—which carry mandatory life sentences without parole—to second-degree murder, manslaughter, or a complete acquittal based on traditional grounds or a finding of lack of criminal responsibility. An insanity-based verdict would not mean immediate release, as a judge could order commitment to a state psychiatric facility pending future evaluations.
Before reporting their deadlock, the jurors asked only a limited number of questions, including requests to examine the knife used by Clancy and the prescription medication containers found on her nightstand in the family’s Duxbury home. As the panel continues deliberating behind closed doors, court observers and attorneys await whether the current standoff will resolve or culminate in a mistrial.
