Truth Social Sale of Fast Access to Trump Posts Draws Legal Concerns

Trump Media launched a subscription data feed selling instant access to President Donald Trump’s Truth Social posts for up to $100,000 monthly. The move triggered a federal lawsuit from The Intercept and the Freedom of the Press Foundation, while Democratic senators asked the SEC to investigate potential market manipulation.

Wall Street firms and high-frequency trading companies are paying between $60,000 and $100,000 a month to gain access to a direct application programming interface feed for Truth Social, according to the company’s earnings call disclosures. More than 10 customer agreements have already been signed for the service, which delivers presidential social media posts split seconds faster than the public can see them.

For high-frequency trading algorithms, those milliseconds provide a critical advantage. President Trump frequently uses Truth Social to announce executive orders, national security developments, and tariff policies that can send bonds, stocks, and oil prices sharply higher or lower.

Federal Lawsuit Filed in New York Over Truth API Monetization

The monetization scheme, branded as Truth API, prompted a federal lawsuit filed Wednesday in the Southern District of New York by The Intercept and the Freedom of the Press Foundation. The complaint argues that charging up to $100,000 monthly for preferred access to presidential statements violates the First Amendment rights of journalists and the public to equal access to government information.

The lawsuit names President Trump in an official capacity alongside Natalie Harp, Deputy Chief of Staff Daniel Scavino, the Executive Office of the President, and the White House Office. Legal support for the action was provided by Citizens for Responsibility and Ethics in Washington.

Constitutional Arguments and Financial Stakes for Trump Media

Beyond First Amendment claims, the lawsuit asserts that the subscription model violates the Fifth Amendment by charging unreasonable sums for public information and undermining equal protection under the law. Plaintiffs describe the arrangement as an out-of-an-out plan of extortion.

The venture is designed to generate high-margin, recurring revenue for Trump Media and Technology Group, which operates Truth Social. Interim CEO Kevin McGurn told analysts during the company’s first earnings call that the firm recognized a modest amount of revenue from the initial agreements and expects the feed to become a durable financial contributor.

No shareholder stands to gain more financially than President Trump, who holds the largest single stake in the company through a trust established when he retook the White House in January 2025. That 52.1 percent stake was initially valued at $4 billion, though subsequent stock declines have reduced the value of his holdings to around $1 billion.

Regulatory Scrutiny and Diminishing Platform Traffic

The commercial strategy arrives as Truth Social faces broader traffic challenges. Similarweb data indicates that Truth Social attracted 261,300 daily active users in July, marking a 40 percent drop compared with the previous year. That user base remains dwarfed by platforms like X, which averaged 123.5 million daily active users during the same month.

Financial filings show Trump Media reported $1.7 million in sales last quarter alongside a $238 million loss, significantly higher than the $20 million loss recorded during the same period a year earlier. The company has never reported a quarterly profit.

The data feed business model has also attracted congressional scrutiny. Democratic Sens. Elizabeth Warren and Adam Schiff urged SEC Chair Paul Atkins to investigate whether the arrangement violates federal securities law, warning that early access for wealthy insiders would erode investor confidence in basic market fairness.

Trump Media countered in a statement that presidential communications already flow through countless platforms and news outlets, while representatives for the defendants and for Trump Media have not yet commented on the ongoing litigation.
