California Gov. Gavin Newsom issued an executive order to rein in artificial intelligence companies and call on the federal government to take a more active role in regulation, according to Fox Business. Newsom signed the order Friday, stating that the administration of President Donald Trump has abdicated its responsibility to protect Americans as AI systems become more advanced and capable.
California Governor Issues Executive Order on AI Oversight and Kill Switch
The governor argued that the federal government has done nothing and noted that there is still no comprehensive federal law requiring artificial intelligence companies to report dangerous incidents when they occur. According to Ca, President Trump has rejected calls for new regulations that would increase security, protect health and safety, and defend the well-being of the American people, recently dismissing AI risks as a hoax.
Accelerating State Laws and Independent Audits
The new executive order directs the Government Operations Agency to accelerate implementation timelines for recently enacted California legislation. Specifically, the order moves up the implementation of California’s AI auditor registry and oversight program from January 2029 to December 2027.
These actions build upon previously signed legislation, including Senate Bill 813 by McNerney, which established a framework for independent verification organizations to assess AI systems and models for safety and risk. Furthermore, Governor Newsom previously signed AB 1405 by Bauer-Kahan, creating a state registry for independent AI auditors to evaluate compliance with state law under standards of independence, transparency, and integrity.
Proposals for Frontier AI Labs and Safety Incidents
Under the executive order, the state will convene national experts, in consultation with the Governor’s Office of Emergency Services, to develop recommendations for strengthening state law regarding frontier AI companies. The proposed measures include:
* Requiring frontier AI companies to embed a designated independent verification organization onsite in their labs to conduct regular audits and evaluations. * Mandating that AI safety frameworks, transparency reports, and risk assessments filed by frontier AI companies under state law are verified by standards deemed adequate by an independent verification organization. * Updating definitions of critical safety incidents to incorporate loss-of-control events, such as the Hugging Face attack. * Advancing the creation of a “kill switch” for frontier models, with ongoing verification of the switch’s efficacy handled by an independent verification organization.
Developing the AI Kill Switch Concept
Governor Newsom acknowledged in a video message published on his personal YouTube channel that the concept of a “kill switch” for out-of-control artificial intelligence systems is still largely in its infancy. Because the term can mean various things depending on the speaker, the state plans to convene a panel of experts to flesh out the definition and establish a working framework.
